Terms of Service

These Terms of Service (the "Terms") govern the access to, and use of, the simcreatio / 심크리티오 website (the "Site") and the services made available through it (collectively, the "Service"). The Site is operated by JaeKyeong Sim / 심재경 and is offered free of charge. By accessing or using the Site, you agree to be bound by these Terms; if you do not agree, please discontinue use.

1. Acceptance of Terms

By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and the Privacy Policy. If you are using the Site on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Definitions

  • "Operator" — simcreatio (Sim Jeong-gyu / 심정규), the individual operating the Site.
  • "Service" — the project content, blog posts, like/comment/follow engagement features, and external form links offered through the Site.
  • "User" or "you" — any individual who accesses or uses the Site. The Site does not require account registration.
  • "Comment" — text posted by a User through the Site's comment feature. Comments on the Site are always anonymous; no name, email, or contact information is collected as part of the comment feature.
  • "Content" — text, images, video, source code, blog posts, and other materials published by the Operator on the Site.

3. Description of the Service

The Service includes:

  • Personal projects, technologies used, and related links;
  • Blog posts (development insights, technical guides);
  • Anonymous engagement features: likes, comments, and follows;
  • Links to an external "Subscribe to updates" form (Google Forms) on project and blog detail pages.

The Site does not provide an on-site contact form. Inquiries are received only by email at [email protected].

4. Eligibility and User Conduct

The Site is not intended for use by children under the age of 13 (under 16 in the EEA, where applicable). By using the Site you represent that you are at least the minimum age applicable in your jurisdiction.

You agree not to use the Site in any of the following ways:

  • To engage in illegal activity or to violate any law or regulation;
  • To infringe on the intellectual property or other rights of the Operator or any third party;
  • To access the Site by means of bots, scrapers, or other automated tools, except for well-behaved search engine crawlers respecting robots.txt;
  • To distribute malware, viruses, spam, harassing, defamatory, or fraudulent content;
  • To post sexually explicit, violent, or otherwise harmful material;
  • To impersonate another person or entity;
  • To collect or expose other Users' personal information;
  • To interfere with security features or attempt unauthorised access to systems.

The Operator may, at its discretion, remove material or suspend access in response to violations of these Terms or applicable law.

5. User-Generated Content (UGC)

User-Generated Content on the Site is limited to comments. Because comments are always anonymous, the Site does not collect any name, email, or contact information through the comment feature.

  1. Ownership. You retain copyright in any comment you post.
  2. Licence to the Operator. By posting a comment, you grant the Operator a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that comment solely for the purpose of operating and promoting the Site. This licence terminates when you delete the comment.
  3. No AI training. The Operator does not use comments to train AI or machine-learning models without your prior, explicit consent.
  4. Moderation. The Operator may remove or hide comments without prior notice if they violate these Terms, applicable law, or the rights of others.
  5. Deletion. Requests to delete a comment are handled promptly. The Operator does not operate a separate automatic deletion mechanism.

6. Intellectual Property

All Content authored by the Operator (text, images, video, design, source code) is owned by the Operator or its licensors and is protected by copyright, trademark, and other intellectual property laws. Specific Content may be released under open licences (such as Creative Commons), in which case the applicable licence terms are clearly indicated and prevail over this section. You may not copy, redistribute, or commercially exploit such Content without prior written permission, except as expressly permitted by the applicable licence.

7. Service Availability

The Operator uses reasonable efforts to keep the Site available, but does not guarantee uninterrupted, error-free, or secure access. The Site may be unavailable due to scheduled or emergency maintenance, technical issues, or failures of third-party hosting, CDN, or infrastructure services (such as Cloudflare or Supabase). The Site is offered free of charge and is not subject to any service-level agreement (SLA) or service credits.

8. Disclaimer of Warranties

THE SITE AND THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR UNINTERRUPTED OPERATION. The Operator does not warrant the accuracy or completeness of any information published on the Site, which is provided for general informational purposes only and does not constitute professional advice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, the Operator shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses arising out of or in connection with your use of the Site, even if advised of the possibility of such damages. The Operator's total cumulative liability arising out of or relating to the Site or these Terms shall not exceed the greater of (a) fees paid by you in the prior twelve (12) months (which is USD 0 for free use of the Site) or (b) USD 100. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable consumer protection laws.

10. Indemnification

You agree to defend, indemnify, and hold harmless the Operator from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your violation of these Terms; (b) your User-Generated Content infringing the rights of any third party; or (c) your violation of any applicable law or regulation.

11. Termination

The Operator may terminate or suspend your access to the Site at any time, with or without notice, in response to a violation of these Terms or applicable law. You may discontinue use of the Site at any time. Sections that by their nature should survive termination — including Sections 5 (UGC licence in respect of content not deleted), 6 (Intellectual Property), 8 (Disclaimer), 9 (Limitation of Liability), 10 (Indemnification), and 12 (Governing Law) — will continue to apply after termination.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of laws principles. Any dispute arising out of or in connection with these Terms shall be brought exclusively in the courts of the Republic of Korea, with the Seoul Central District Court having jurisdiction in the first instance. Users covered by consumer protection laws may also seek dispute resolution through the Korea Consumer Agency (kca.go.kr · 1372). Nothing in this section limits any rights you may have under applicable consumer protection laws.

13. Modifications to These Terms

The Operator may modify these Terms from time to time. Material changes will be posted on the Site at least 7 days before they take effect, and 30 days before for changes that materially affect User rights. The "Last Updated" date at the top of these Terms will be revised accordingly. Your continued use of the Site after the effective date constitutes acceptance of the revised Terms.

14. General Provisions

  • Severability. If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.
  • Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Operator regarding the Site.
  • No Waiver. The Operator's failure to enforce any provision of these Terms is not a waiver of that provision.
  • Assignment. The Operator may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign these Terms without prior written consent.
  • Force Majeure. Neither party is liable for any failure to perform due to causes beyond reasonable control.
